GENERAL TERMS AND CONDITIONS
(GTC) OF KANOPET AG
These General Terms and Conditions (GTC) govern the legal relationship between Kanopet AG (the “Seller”) and its customers (“Buyer”) with regard to all contracts concluded between the parties. Any terms and conditions of the Buyer that conflict with these GTC are hereby expressly excluded.
By placing an order, the Buyer expressly agrees to these GTC.
The offer of the Seller is non-binding. The Seller therefore reserves the right to make changes to its prices and product range, as well as technical changes. Product information, such as images, size, colour and weight, is based on non-binding information from the manufacturer. Products are always offered subject to availability for dispatch on the part of the Seller or a contractual partner of the Seller.
Conclusion of contract
By visiting www.kanopet.ch and placing an order, the Buyer makes a legally binding offer to enter into a contract. By accepting the order on www.kanopet.ch, the Seller undertakes to deliver the goods as quickly as possible. The contract comes into force when the Seller accepts the offer
by sending an order confirmation by email, post or fax, or by dispatching the goods. The conclusion of a contract is always subject to availability for dispatch on the part of the Seller or a contractual partner of the Seller. All liability is excluded if the Seller is unable to send the goods because
they are out of stock or no longer available or due to a shortage. The language of the original contract is German. The Seller shall store the text of the contract and send the order details and GTC to the Buyer by email. The GTC can therefore be viewed at any time.
All prices are shown in Swiss francs (CHF). Prices are net and are not based on the order quantity. No shipping costs apply to deliveries made in Switzerland and Liechtenstein.
Delivery takes place only after payment has been made by the Buyer.
No shipping costs apply to deliveries made in Switzerland and Liechtenstein. The Buyer is entitled to withdraw from the contract if a delivery is delayed for more than 30 days. However, the Seller reserves the right to send the Buyer an item of equal price and quality if the ordered product is not
available. The Seller cannot then be held liable for delivery delays caused by manufacturers or third parties.
Right of return
Purchased goods can be returned to the following address at the expense and risk of the Buyer within eight days of delivery, with the delivery order or invoice enclosed: Kanopet GmbH, Bachhaldenstrasse 15, 6144 Zell, Switzerland. This excludes items that have already been used. The goods must be complete, undamaged and in their original packaging, otherwise the Seller may make a deduction of the credit at its own discretion. The credit is
made at the current price valid on the day of return.
Unless agreed otherwise, the provisions of the Swiss Code of Obligations concerning purchase of movable property (Art. 184 ff. OR) apply. If it has issued a warranty, the Seller shall decide whether to carry out a repair or send a replacement. The warranty does not cover damage for which the Buyer is solely responsible; e.g. due to improper use, natural wear and tear, or other external influences for which the Seller is not responsible.
All other claims of the Buyer are excluded, regardless of their legal grounds. The Seller, its auxiliaries and any vicarious agents cannot be held liable for damage that has not occurred to the goods themselves, in particular not for lost earnings or other financial damage suffered by the Buyer. The Seller cannot be held liable for deviations in the goods as they are natural, hand-made products.
The Seller complies with Swiss data protection legislation in the collection, processing and use of personal data. For information on handling of personal data, please see the separate declaration at www.kanopet.ch. For the purpose of quality assurance, the Seller expressly reserves the right to record conversations when orders or complaints are submitted by phone.
Amendments to the GTC
The Seller reserves the right to amend the GTC at any time.
Applicable law and place of jurisdiction
All obligations arising from this contractual relationship are subject to Swiss law. The applicability of the UN Convention on Contracts for the International Sale of Goods is excluded. The place of fulfilment and of exclusive jurisdiction is Zurich, Switzerland.
